Mawu Africa Seller Terms & Conditions

By registering and operating a shop on mawuafrica.com, you ("Merchant") agree to comply with these Terms & Conditions, which govern your access to and use of the Mawu Africa marketplace (the "Platform"). Please read them carefully before signing up.


1. Payment Accounts

1.1 Account Creation
To use Mawu Africa's seller services, you must provide complete and accurate personal and business information during registration and update it as needed. You may not impersonate anyone or use a name you’re not legally authorized to use.

1.2 Account Verification
You authorize Mawu Africa and its authorized agents to verify your identity and information, including through public records and credit checks, to maintain platform integrity and comply with laws related to fraud, money laundering, terrorist financing, and trade sanctions.


2. Fees & Payments

2.1 Fee Agreement
By creating a store on Mawu Africa, you agree to our fee structure and payment terms as outlined here and in our broader Terms of Use.

2.2 Transaction Fees

  • Retail Orders: 10% transaction fee

These fees apply to the total listing price (including applicable taxes but excluding shipping). If personalization options are offered for an additional cost, the added amount is also subject to the same transaction fee. Fees are automatically deducted from your account balance upon each sale.


3. Terms of Sale

By using the Platform, you agree to the following terms:

3.1 Definitions

  • "Marketplace" – Mawu Africa's e-commerce platform where products are listed and sold.

  • "Merchant" – A registered seller offering products on the Marketplace.

3.2 Registration & Account Management

  • You are responsible for providing and maintaining accurate registration details.

  • You must protect your login credentials and are liable for all account activity.

  • Notify us immediately of any unauthorized access or security breaches.

3.3 Merchant Obligations

  • Comply with all local and international laws regarding your business and products.

  • Accurately represent your products, including descriptions, pricing, and images.

  • Promptly fulfill all customer orders and provide clear shipping information.

  • Avoid fraudulent, deceptive, or misleading practices on the platform.


4. Product Listings

  • You must own or have rights to sell the listed products and ensure they don’t infringe third-party rights.

  • All listings must be truthful and clearly describe the product or service offered.

  • By listing products, you grant Mawu Africa a non-exclusive, royalty-free, worldwide license to use, display, and promote your listings across the platform.


5. Orders & Fulfillment

  • You are obligated to fulfill all customer orders promptly and offer high-quality service.

  • Applicable platform fees and commissions will be communicated and deducted as per Section 2.


6. Payments & Settlements

  • Mawu Africa processes customer payments on your behalf.

  • Net earnings (after deductions of fees) will be transferred to your nominated account as per our payment schedule.


7. Intellectual Property

  • You retain all ownership rights to your content and product listings.

  • You grant Mawu Africa the right to use your intellectual property solely for the promotion and operation of your store on the platform.


8. Termination

  • Either party may terminate this agreement at any time with written notice.

  • Mawu Africa may suspend or terminate your account if you breach these terms or engage in prohibited activity.


9. Limitation of Liability

To the maximum extent permitted by law:

  • Mawu Africa is not liable for indirect, incidental, or consequential damages arising from your use of the Platform.

  • Our total liability for any claim will not exceed the total fees paid by you in the six (6) months preceding the incident.


10. Governing Law & Dispute Resolution

These terms are governed by the laws of the Republic of Kenya. Any disputes will be resolved through arbitration in accordance with Kenyan law.


11. International Pricing & Geo-Pricing Policy

11.1 Seller Responsibility for Pricing
As a merchant on Mawu Africa, you are solely responsible for setting and managing the prices of your products. You must ensure that your listed prices are accurate, reflect your intended retail or wholesale value, and include any applicable taxes or duties required in your country of operation.

11.2 Sales Across Markets
Mawu Africa is an international marketplace serving buyers across multiple countries and regions. By listing on our platform, you agree that your products may be marketed and sold in various international markets.

11.3 Geo-Pricing Adjustments
To improve buyer experience and enhance conversion rates in global markets, Mawu Africa may apply geo-pricing to approved listings. This means we may adjust the displayed product price in certain regions to factor in high shipping and logistics-related costs, including customs handling and cross-border surcharges.

  • Important: This geo-pricing adjustment does not affect your listed price or your earnings.

  • The difference is derived from a portion of the shipping cost being blended into the product price to reduce the appearance of a high shipping fee at checkout.

  • This is a marketing strategy aimed at improving affordability perception and increasing sales in global markets.

11.4 Seller Earnings
You will still receive payment based on the original product price you listed on Mawu Africa, less applicable transaction fees as described in Section 2.


Acknowledgement

By registering as a Merchant on Mawu Africa, you confirm that you have read, understood, and agree to abide by these Terms & Conditions. Failure to comply may result in account suspension or termination.
